Hartford City Rescinds Four Property Sales, Will Rebid Without Minimum Prices

The Hartford City Common Council rescinded all four city-owned property sales it had approved earlier in the same meeting, then voted unanimously to reopen bidding with no minimum price requirement.

The council initially approved bids on four properties — 414 North Monroe, 705 West Franklin, 802 South Pearl, and 806 South Pearl. Bids ranged from $1,000 to $3,000. But City Attorney Tyler Rothstein then revealed the minimum offering prices set when the properties were originally listed: $9,800 for 414 North Monroe, $9,500 each for 802 and 806 South Pearl, and $4,820 for 705 West Franklin. None of the bids met those minimums.

A member of the public pointed out that the minimums had discouraged potential buyers. "I know of people that wanted to bid on it, but they were under the impression that that was a reserve," the commenter said.

Rothstein explained that under Indiana Code §36-1-11-15, the city is not required to accept bids below the minimum offering price but may do so if no eligible bids come in. He recommended reopening all four properties to new bids. Councilman Michael Wolfe moved to rescind all bids for due process and equal protection reasons — either reopen all or none.

All four approvals were rescinded 5-0. The council then voted 5-0 to reopen bidding from August 6 through August 28 with no minimum bid requirement. Properties will be re-listed on the city website and social media. Existing bidders may resubmit or withdraw. The next council meeting is September 8 due to the Labor Day holiday.
